How can we help when you are preparing an IPR petition?

Although it has not escaped some criticism, the use of the post-grant patentability challenges at the Patent Trial and Appeals Board (PTAB) continues to increase, confirming the roles of these proceedings as an alternative to litigation in challenging patent eligibility and validity.

Our experts have been following the developments of these proceedings carefully, and the use of Inter Partes Review (IPR) in particular, in order to gain a better understanding of the success factors. They use this information to refine their work for this purpose, defining search scopes and adjusting reports and claim charts, to support our customer’s petitions in the best possible manner.

Nordic Patent Institute has outstanding resources to handle search requests for Patent Trial and Appeals Board (PTAB) purposes, including:

  • 150 highly trained, multilingual Nordic patent examiners covering all technical fields
  • State-of-the-art search tools including EPO's EPOQUENET and a vast collection of global patent and non-patent databases
  • A proven track record, finding references of particular relevance or obviousness-type references in about 70% of our validity searches

Like many others, we expect the PTAB Trials to continue to grow in popularity and we will continue to adapt our services even more to meet the requirements for this market.
